Mishap Due To Heart Attack ‘Covered Under Insurance' According to the Delhi Consumer Commission, if a life insured person suffering from heart disease dies in an accident due to a cardiac arrest is entitled to accidental insurance claim.

Commission Head Justice J D Kapoor said, “If any person meets with an accident... and if death occurs due to myocardial infarction consequent to coronary artery disease, precipitated during vehicular accident, it amounts to accidental death and entitles the insured person for accidental claim benefit.”

The judge passed an order in case of Jagdish Lal. He was covered under a LIC policy for 50,000, met with an accident and died in 2004.

According to the policy, Jagdish Lal was entitled to double the sum assured and not exceeding Rs 500,000 but LIC deny giving compensation to his wife and took the plea that the accident was caused due to his own negligence.  

Lal's widow Veena Dhingra was forced to approach the district forum as LIC denied her accidental claim of Rs 50,000. On September 14, 2006, the forum had directed LIC to pay 63,000 including the compensation within a month to Veena Dhingra after holding that her husband's death was duly covered under the policy.
