HTC files appeal ITC ruling favoring Apple

HTC files appeal ITC ruling favoring Apple Taiwanese handset maker, HTC has filed an appeal against a U. S. International Trade Commission preliminary ruling favoring Apple.

A preliminary ruling has concluded that some Apple products did not violate patents held by S3 Graphics, according to a statement released by the company. HTC is under the process of taking over S3 Graphics. The U. S. commission released details of a July 1 ruling which favored S3 and declared that some of Apple products did not violate its patents. The commission did not agree that Apple iPad and iPhone violated its patents. HTC said in the statement that it will appeal this finding.

Earlier, on July 15, the U. S. International Trade Commission had said in an initial ruling that the company had violated two patents belonging to Apple. The two patents relate to a "system and method for performing an action on a structure in a computer" and a "real-time signal processing system for serially transmitted data."

Apple alleges that HTC’s phones are using features that are patented by the company and are offered on its iPhone smartphone. The ITC administrative law judge said in the initial judgment that HTC infringed upon two of 10 patents Apple had filed a complaint over in March 2010, according to HTC.
