Apple: Jury foreman Velvin Hogan’s comments were 'balanced, not biased'Apple has recently filed its 30-page response to Samsung's October 2-filed paperwork in which the South Korean firm had requested a new trail - after an Apple-favoring federal jury verdict in San Jose in August - in the companies' patent-infringement lawsuit.

With the jury having awarded Apple $1.05 billion in damages from Samsung, objections were raised by Samsung over the involvement of jury foreman Velvin Hogan; as well as over the mammoth damages tally and patent issues. In the wake of these objections, Samsung had requested a new trial in the case.

However, countering Samsung's objections, Apple said in a recent filing that the Samsung's attack on the jury's findings was "clearly unfounded." In addition, Apple has also argued that Samsung does not "meet the high bar" in either obtaining judgment or new trial on the basis of any of its objections to the August ruling by the federal jury.

About Samsung's objections to Hogan's involvement and the argument that the jury foreman had not disclosed his 1993 legal scuffle with Seagate - in which Samsung has recently acquired a 9.6 percent stake -, Apple said Samsung should have brought up the issue in the trial and should have "asked Mr. Hogan about Seagate."

Noting that Samsung has missed its chance on the Seagate front, Apple claimed in its filing that the intellectual property-related comments made by Hogan were "balanced, not biased."
