Supreme Court Directs NDTV In BMW Sting Operation

On Tuesday, the Supreme Court directed the news channel, NDTV to produce the original footage of the sting operation they conducted in BMW case on the reputed lawyers R K Anand and I U Khan. The court asked to bring forth the material used in the operation such as computerized chips and other relevant evidences.

The bench which gave the verdict was comprised of three judges, Justices B N Aggrawal, G S Singhvi and Aftab Alam. The case was bought to the apex court's notice when the senior counsel Altaf Ahmed defending Anand said that the alleged tapes were tampered with and was a controversy to defame him and Khan.

Anand was the defence counsel and I U Khan, the public prosecutor in the BMW hit-and-run case wherein the lawyers were reportedly accused of influencing the chief witness Sunil Kulkarni. The former however claimed that the High Court did not give them the opportunity to justify themselves as he pleaded for cross examining of the tape in which they were held to be at fault and also the reporter who filmed it.

The apex court has also appointed Additional Solicitor General Gopal Subramaniam and senior counsel Nageswara Rao to assist in the case as amicus curiaes. The bench held that these officials will help in examining the electronic material, a part of evidences.

The SC said that the notice given to the channel was merely for arriving at the truth and was not in any form "adversarial litigation". The next hearing is scheduled for 18th November.
