Need For Creating Land Transfer Code

The Singur land acquisition has taken a new turn as questions are being asked over the possibility of creating a land transfer code. It has come to light that the land which was acquired by the Supreme Court by using “emergency clause” is actually being use for an entirely different purpose.

It is believed that these activities by the court might bring conflict among the masses. The government has paid the farmers for the land; developers have paid the government to get this land and an unsuspecting group of people has paid the developers to book residential plots and premises.

Considering the forecasted chaos among the farmers and the land buyers, it is being felt that it is high time to introduce a third party – like government to address the issues. The third party thus formed will be responsible for transferring from private farmers to private developers.

It has been observed that the main cause of dispute is that there are usually a large number of small sellers and a small number of users of the aggregated land. Another issue faced during the transfer is that half the land has a value that is much less than half of what all the land could generate. To meet these challenges it is necessary to form a transfer code which will help the buyer and sellers to strike a healthy deal.
