Center for ESMA against striking truckers
The indefinite strike called by transports has entered the third day. The Union Government has asked all states to ensure supply of essential goods across the country. The states are advised to use the Essential Services Maintenance Act (ESMA) and the National Security Act (NSA) to get transporters back on work. ESMA allows government to arrest the truckers who are disrupting the flow of essential services. The center has also asked states to cancel permits of trucks to deal with situation.
Union minister for shipping, transportation and industries, TR Baalu said, "I appeal to truckers to call off their strike and return to the negotiating table. It is unfair on their part to seek a reduction of Rs 10 in diesel prices at one go."
A press release by government maintains, "The suggestive action plan includes declaring transport services as an essential service and invoking ESMA, NSA, other legal instruments, cancellation of permit under Section 86 of the Motor Vehicles Act, 1988, requisitioning trucks and lorries under relevant legal provisions, involving local traders/business community etc."
Government asked states to use other modes of transportations which don't requires permit under the provisions of the Motor Vehicles Act, 1988. Indian Railways has been directed to make adequate arrangements to avoid any crisis. Meanwhile, Railway authorities have asked zonal offices to help in smooth supply of perishable goods, food and grains for public distribution system.
