Islamabad, Nov 22: A contempt petition has been field against President Pervez Musharraf in the Supreme Court under various sections of the Constitution, which have not been suspended under the Provisional Constitutional Order (PCO) promulgated after emergency was imposed in Pakistan on November 3.

Communist Party of Pakistan (CPP) Chairman Jameel Ahmad Malik has filed the petition under Article 204 of the Constitution, and appealed to the apex court to start contempt proceedings against Musharraf.

The petition said that in 2004, the CPP in its constitutional petition had challenged Musharraf's holding of two offices, but the SC had allowed Musharraf to hold the offices of the Army Chief and the President till November 15, 2007, the Daily Times reported.

The CPP argued that Musharraf had to doff his uniform on November 15, but by continuing in the two offices after the apex court's deadline, Musharraf had committed contempt of the Supreme Court judgment.

The judgment was given on April 13, 2005 by the five-member larger bench headed by former Chief Justice of Pakistan Nazim Hussain Siddiqui.

Justice Abdul Hameed Dogar, the present Chief Justice of Pakistan, and Justice Faqir Muhammad Khokhar, were among the members of the bench.

The CPP maintained that by keeping two offices after November 15, Musharraf has no justification with the stay granted by the 11-member apex bench, that says his presidential election result cannot be notified till the court's decision on constitutional petitions against him. (ANI)
