Google wins IPR cases against Ascio Technologies and Net Jobs
The internet search giant, Google secured significant victories in its Intellectual Property Rights (IPR) cases against two Indian companies last month. The World Intellectual Property Rights Organization (WIPO) gave its verdict in favor of Google, in its domain names’ cases against Ascio Technologies and Net Jobs, and the WIPO arbitration and mediation committee transferred the domain names "googlehrd.com" and "mygooglemoney.com," used by the two Indian companies, to Google.
Google was disputing with the two Indian entities for using its tradename in their respective domain names. Seeking the transfer of domain names “googlehrd.com” and “mygooglemoney.com” used by two Indian entities, Google filed complaints against Kolkata-based Ascio Technologies and Rajasthan-based Net Jobs, with the World Intellectual Property Rights Organization (WIPO), a UN agency to safeguard IPR.
In its complaints, Google alleged Sudam Chakraborty and Thilak Raj, the owners of the two Indian companies, of illegally using its tradename in their domain names to seek advantages in their respective businesses. Google complained that the two companies Ascio Technologies and Net Jobs were violating its intellectual property rights (IPR) by using its trade name in their respective domain names 'googlehrd.com' (Ascio Technologies) and 'mygooglemoney.com' (Net Jobs) for commercial purposes.
In the judgment, Christian Schalk, the only panelist in both the cases, maintained that the two Indian companies registered the domain names in “bad faith” to confuse web users for commercial interests. Schalk held that the two companies had no rights to use Google’s trade name in their domain names and ordered the transfer of domain names to Google. The suits were settled under Uniform Domain Name Dispute Resolution Policy (UDRP), after Sudam Chakraborty and Thilak Raj failed to stand firm against the notices sent to them by the Geneva-based arbitration tribunal.
