Canadians all set to settle chocolate conspiracy
According to the reports, Canadians could get a sweet deal worth $6 million to end a chocolate pricing conspiracy case against Cadbury Adams Canada Inc. after a judge allowed the offer.
The Canadian Broadcasting Corp. has reported that the British Columbia Supreme Court ruled Friday to allow the settlement agreement offered by Cadbury and its distribution company, Itwal Ltd. The broadcaster also said that Hershey Canada Inc. is appealing the decision.
Cadbury is named in a class-action suit along with Hershey, Nestle Canada Inc. and Mars Canada Inc. The suit came after Canada's Competition Bureau alleged the manufacturers conspired to artificially inflate the price of chocolate bars sold from 2001 to 2008.
Luciana Brasil, a Vancouver attorney involved in the suit, said, "We were able to negotiate a very favorable settlement. If we're able to ultimately resolve all the claims against the other parties, then all [plaintiffs in the class action] are going to potentially benefit."
It wasn't clear what form Cadbury's settlement offer would take, Brasil said.
Brasil further said that the class action applies to anyone in Canada who bought chocolate made by Nestle, Hershey and Mars between 2001 and 2008. (With Inputs from Agencies)
