On Wednesday, federal prosecutors sued a Manhattan plastic surgeon as he not only ended a consultation with a 50-year-old man in July 2014, after he unveiled of being HIV positive, but he also refused to carry out a breast reduction surgery on him.

The man was taking treatment for a side effect of cancer and HIV medication. The feds filed the civil rights lawsuit against Advanced Cosmetic Surgery on the Upper East Side after Dr. Emmanuel Asare stated that he would not operate on the man’s swollen chest.

His chest was inflamed either due to his cancer or anti-HIV medications. After the investigation, it was found that the doctor refused because it was the policy of the Advanced Cosmetic not to treat those living with HIV, cancer or diabetes.

Such a kind of refusal is illegal. As per the lawsuit, the center has refused to treat at least two other people owing to HIV. Manhattan U.S. Attorney Preet Bharara said that medical providers cannot simply refuse to provide treatment because patient is suffering from medical condition like HIV.

“Individuals with disabilities are entitled to the same medical services as everyone else, and there can be no room in the medical profession for the kind of discrimination alleged in this lawsuit”, said Bharara.

On the other hand, Advanced Cosmetic stated that they only perform plastic surgeries and all their patients ‘should be in healthy condition’. But Bharara seems to be different mode and stated that anyone who thinks that a doctor or any other provider is not serving people with disabilities then they can freely contact his office’s civil rights unit.
