PIL against BSP rally dismissed by HC
Recently, PIL had asked for a CBI probe into the alleged misuse of public money in the March 15 BSP rally and also claimed that BSP used money obtained from unknown sources. However, Monday saw high court declaring that these allegations are based on self-assessment and it did not press the charges.
The PIL filed by a local lawyer was dismissed by the division bench of acting Chief Justice Amitava Lala and Justice Anil Kumar, accordingly. The PIL was described by the bench as being based on only newspaper clippings that carried no proof value in law. As per the judges, the petitioner failed to bring on record any notable material on which a prima facie case could be made.
The PIL was opposed by UP advocate-general Jyotindra Mishra and chief standing counsel Devendra Upadhyay since there was not even a single substantive material on record in regard to the allegations made in the PIL.
It was specified that the money spent on UP State Road Transport Corporation (UPSRTC) buses occupied in transporting the rallyists, had been paid by the organizers of the rally.
But how much money was spent on all the arrangements of the rally was not revealed by them.
The PIL forwarded misusing of the state machinery in the rally and also claimed that public fund was misappropriated by the government with the intention of making arrangements for the rally of the ruling party.
