Land Act changes a booster for realty

The Ashok Gehlot Government's decision to make use of agriculture land for residential schemes easier is likely to revive the real estate market in the state.

The builders and consumers of the state believe the amendments in Section 90-B of the Rajasthan Land Revenue Act, which deals with use of land for residential schemes, will give a boost to the market that has seen poor sales due to global recession.

With provision of time-bound approval of the schemes, the cost of budget involved in construction process will be reduced that will further extend benefit to the buyers, both investors and end users. The realtors feel that the new amendments would give a fillip to the real estate market and ensure transparency.

As per new amendments, the applications for layout plan approval, 90-B proceedings and land use conversion will be filed together and given clearance within 120 days. With this, there is hope of clearance of all pending files. As per sources, nearly 80 files are still pending in UDH for clearance while more than 100 files are pending with JDA. Disposal of these files is expected to clear thousands of square metres of land.

"It is a judicious move that will benefit the end consumers and the builders equally. Timely clearance of a project will save unnecessary costs caused due to delay in seeking permission from the government," said Atma Ram Gupta, a leading realtor of the city.

Bhanwar Lal Gupta of Jagatpura who made several rounds of JDA office and UDH seeking land use conversion for his 900 bighas land is now hopeful that he will get permission and use his land for commercial purposes. "I have waited

for more than a year but now there is hope of getting clearance at least in a month or two,” he said. Chairman of Rajasthan Builders and Promoters Association, Gopal Gupta says, “Provision of sending monthly report to the government will fix liability of the officials concerned that will help in checking corruption. Transparency and proper monitoring are main features of new amenedments"

Section 90-B deals with land use conversion from agricultural land to commercial land. Under this section, the title of agricultural land is transferred to the government when it is used for commercial purposes. Later, the land title is converted into commercial one and can be further sold.
